Total Terminals International, LLC (TTI) is committed to protecting the privacy and security of your personal information. This Privacy Policy (the “Policy”) describes how TTI collects and uses personal information.

This Policy describes how we at TTI may collect and use personal information about you that we obtain from you, including through www.totalterminals.com and other websites and applications that link to this Policy (collectively, the “Websites”).

“Personal information” in this Policy includes information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with any individual or household. Personal information does not include publicly available information that is lawfully available to the general public.

We collect data about users of the Websites; about individuals who contact us online, by telephone or electronic means, or in person; about individuals who visit our facilities or operations; about individuals who attend events organized or hosted by us; about our customers or prospective customers (where these are natural persons) or their employees, agents, and representatives; and about others who express an interest in us or with whom we carry on business (collectively, these individuals about whom we collect data are referred to as “you” and “your” in this Policy).

We are based in the United States and the information we collect is governed by U.S. law. If you are accessing the Websites from outside of the U.S., please be aware that information collected through the Websites may be transferred to, processed, stored, and used in the U.S. and other jurisdictions. Data protection laws in the U.S. and other jurisdictions may be different from those of your country of residence. Your use of the Websites or provision of any information therefore constitutes your consent to the transfer to and from, processing, usage, sharing, and storage of information about you in the U.S. and other jurisdictions as set out in this Policy.

This Policy describes the treatment of information provided or collected on the Websites or otherwise provided to TTI. TTI follows this Privacy Policy in accordance with applicable law in the places where we operate.

Please know that when you provide information to us on a third-party site or platform, the information you provide may be separately collected by the third-party site or platform. Only the information we directly collect is covered by this Policy, and the information the third-party site or platform collects is subject to the third-party site or platform’s privacy practices. Privacy choices you have made on the third-party site or platform will not apply to our use of the information we have collected directly. Please also note that the Websites may contain links to other sites not owned or controlled by us and we are not responsible for the privacy practices of those sites. We encourage you to be aware when you leave the Websites and to read the privacy policies of other sites that may collect your personal information.

2. SOURCES OF PERSONAL INFORMATION

We collect two basic types of information: personal information and anonymous information. We collect certain personal information that you provide to us while contacting us or otherwise utilizing our services. Personal information means information that identifies (whether directly or indirectly) a particular individual.We also collect anonymous information, which means information that does not identify a specific individual, via automated technology when you visit the Websites.

We collect and use this information only as permitted or required by, and in compliance with, law.If you would choose not to share the requested personal information with us, we would not be able to meet some of our purposes, as described in this Policy.

3. CATEGORIES OF PERSONAL INFORMATION

We collect the following categories of personal information for the purposes described below:

Identifiers

This includes name, contact, driver’s license, Transportation Worker Identification Credential (“TWIC”), and other identification information. We collect this information via the Websites, as well as from visitors, vendors, contractors, and truck drivers who visit our physical location. We use this information to communicate with you, ensure security of our physical location, to provide services, to execute contractual obligations, to meet legal obligations, for management purposes, to ensure damage and criminal acts as well as actions that are prohibited by TTI’s internal policies and procedures, and to conduct internal investigations of suspected criminal or prohibited behavior.

If your business or organization transfers any personal information concerning employees or other representatives to us, we expect your employees, executives, or other representatives to be informed about this. You can give this Policy to them so that they can learn how we deal with their personal information.

Customer Records Information

This includes name, contact, and payment information. We collect this information via the Websites and through other means from clients and their representatives, individuals who show an interest in TTI or our products and services, individuals who are connected in another way with a business or organization with which we have, want to have, or have had a business relationship, security providers, and potential clients. We use this information to enter into a business relationship and agreement with you, perform agreements and carry out instructions, protect your security and integrity as well as the security and integrity of TTI and others, help develop and improve products and services, engage in account management, promotional and marketing, enter agreements with suppliers and other parties we work with, comply with legal obligations, and carry out business processes and for the purpose of management reports and internal management.

Biometric Information

We do not collect biometric information. We have placed CCTV cameras on and around our physical sites. These cameras may occasionally make recordings of you as you pass the areas that are covered by the CCTV cameras. The camera recordings are typically removed after 8 weeks, and no facial recognition or other biometric information is collected from these images. However, the recordings may be kept for a longer period, for example, in case of an accident investigation or other valid reasons.

Internet or Other Electronic Network Activity Information

This includes fully anonymized information related to the activity on our Websites. We use this information solely to ensure the security and performance of our Websites.

Geolocation Information

We collect data related to truck locations. RFID tags are read as trucks enter and process through our facility. This data is used to locate the container associated with the truck to facilitate work instructions. We do not manage or track location data outside the perimeter of our facility and we do not have access to location tracking data that companies use to manage their fleet.

4. SHARING YOUR PERSONAL INFORMATION WITH OTHERS

TTI does not sell, share, or otherwise disclose for monetary consideration your personal information to other parties. TTI may share anonymized data to maximize site security and improve the performance of the Websites.

5. DATA SECURITY

The security, integrity, and confidentiality of your personal information are extremely important to us. We have implemented technological and organizational measures to safeguard your personal information. We will store your personal information as required for the purposes for which it was initially collected, which may vary depending on the type of personal information collected and its purposes.

6. RETENTION OF PERSONAL INFORMATION

TTI will retain your personal information only for as long as needed to carry out the purposes for which it was collected.

7. NOTICE REGARDING MINORS

We do not knowingly collect, maintain, or use personal information from children under 18 years of age, and no part of our Websites are directed to children. By using the Websites, you represent that you are at least the age of majority in your state of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

If you learn that a child has provided us with personal information in violation of this Policy, or you are under 18 and would like information provided to us removed, please alert us at TTICompliance@totalterminals.com.

8. STATE PRIVACY RIGHTS

Residents of certain U.S. states, including California. have unique rights available to them under state data privacy laws. Depending on your residency, you may have the different rights. This section describes those rights and explains how to exercise those rights.

Right to Request Disclosure About the Data Collected About You

You may have the right to request that TTI disclose certain information to you about our collection and use of your personal information. Once we have received and verified your request, we will disclose to you:

  • The specific pieces of personal information we collected about you.
  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting that personal information.

However, TTI will not at any time in response to a request disclose a consumer’s financial account number, an account password, or security questions and answers.
TTI is not required to retain any personal information collected for a single, one-time transaction, if the information is not regularly retained by TTI, or re-identify any anonymous or de-identified information, in order to disclose that information to you.

Correction and Deletion Request Rights

You may have the right to request that TTI correct or delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we have received and verified your request, we will correct or delete your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546et. seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information for data and to delete data. You may only make a verifiable consumer request for data access twice within a 12-month period.

The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. Any request to delete submitted through an online request you will first be required to submit the request, and the second, separately confirm that you will want the information deleted.

For all requests made pursuant to the California Consumer Privacy Act (“CCPA”), we will endeavor to respond to a verifiable consumer request within forty-five (45) days of receipt. If we require more time, we will inform you of the reason and extension period. Any disclosures that we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. For information portability requests, we will also explain the reasons we cannot or will not comply with a request, if applicable.

Non-Discrimination

We will not discriminate against you for exercising any of your data subject rights after you have exercised those rights. Unless permitted by the applicable state law, in response to exercising your rights, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

9. CHANGES TO THIS PRIVACY POLICY

Please note that we may update or change this Policy from time to time at our discretion. When we make changes to this Notice, we will post the updated notice on the Website and update the Policy’s effective date.Your continued use of our website following the posting of changes constitutes your acceptance of such changes. The most current version of this Policy will govern the use of your information.
